Publication of the Draft Law on Carbon Dioxide Storage
The bill of the Ministry of Environment and Energy entitled "Regulations for the capture, use, transport and storage of carbon dioxide - Implementation of Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the storage of carbon dioxide in geological formations and amending Council Directive 85/337/EEC" has been published in the Official Gazette, Directives 2000/60/EC, 2001/80/EC, 2004/35/EC, 2006/12/EC and 2008/1/EC of the European Parliament and of the Council, and Regulation (EC) No 1013/2006 (L 140).
Among other things, Article 75 refers to extensions of planning and zoning regulations, which relate to building permits and pre-approvals, arbitrary buildings, etc.
Article 75
Extensions of planning and zoning regulations
1. 6 of Article 29 of Law No. 4067/2012 (A' 79), on the validity of building permits that fall within the scope of para. (a) of paragraph (a) of this Article. 3 of Article 6 of the Presidential Decree of 7.1993 (D' 795), in order to complete the facades and any roof of the building and to be included in paragraph c) of par. 5 of Article 42 of Law No. 4495/2017 (A' 167), is extended until 31 December 2027.
2.α) The deadline of paragraph c) of par. 2 of Article 51 of Law No. 4178/2013 (A' 174), on modernization and building expansion in legal uses of buildings or facilities, which are maintained, as well as in uses provided for by building permits issued in accordance with Article 26 of Law No. 2831/2000 (A' 140), shall be extended until 31 December
(b) The deadline of the eighth subparagraph of par. 3 of Article 51 of Law No. 4178/2013, on the suspension of the obligation to relocate or remove fuel stations, LPG, natural gas and their associated uses with a legal use, is extended until 31 December 2026.
3. 4495/2017, regarding the submission of documents for the inclusion of arbitrary construction or arbitrary change of use in the provisions of Law 4495/2017. 4495/2017, are extended until December 31, 2027 and for thirty-six (36) additional months from their expiration, respectively.
4. 4 of article 122 of Law No. 4495/2017, on arbitrary constructions in the Evros Delta, shall be extended until 31 December
5.The deadline at the end of the introductory subparagraph of par. 1 of article 125KA of Law No. 4495/2017, on the non-application of paragraph j) of Article 28 of Law 4495/2017. 4495/2017 on the legalization permit for arbitrary constructions or uses installed after 1 May 2024, is extended from its expiry to 30 November
6.The deadline of par. 11 of article 51 of Law No. 4643/2019 (A' 193), on the submission of supporting documents in cases of subjection to the law. 4178/2013, which are not transferred to Law No. 4495/2017 and the cases of subordination to Law No. 4014/2011 (A' 209) that have been transferred to Law No. 4178/2013, shall be extended until 31 December
Extensions of validity of building permits
7.α) As regards the deadline of Article 52 of Law No. 4710/2020 (A' 142), on the validity of building permits, building permits and any revisions thereof:
(aa) the deadline for issuing the mentioned permits shall be extended until 31 December 2023,
(ab) the period of validity of the permits shall be extended until 31 December 2027.
(b) the validity of the pre-authorisations issued under par. 1 of Article 40 of Law No. 40. 4759/2020, shall be extended until 30 June 2026, in case of earlier expiry.
Extension of the suspension of construction works
9. The extension of the time limit of Article 1 of Article 45 of Law No. 5106/2024 (A' 63), concerning the preparation of urban resilience plans, shall be extended from its expiry until 31 May 2026.
10. 4843/2021 (A' 215), on the extension of the suspension of construction works in the area of Mount Hymettus and the Goudi Ilissias Metropolitan Parks, is extended until 31 December 2026, subject to the joint decision of the Ministers of National Defence and Environment, Spatial Planning and Public Works (D' 749), No. 26229/1123/1987, on the conditions and procedure for issuing building permits for the execution of military works.
11. 1 of article 270 of Law No. 5037/2023 (A' 78), on the suspension of building permits in the off-plan areas of the island of Mykonos, shall be extended until the approval of the Special Urban Plan and not beyond 31 December.
12. 1 of Article 77 of Law No. 5151/2024 (A' 173), on the suspension of the issuance of building permits for new buildings or extensions of existing buildings and swimming pools or other water surfaces in the area of Caldera on the islands of Thera and Thirassia, which is shown as Zone Z' in Annex D' of Law No. 5151/2024 (A' 173). 5151/2024, is extended until the approval of the Special Urban Plan and not beyond 31 December
